At The Moment Media Inc. (ATM) is committed to protecting your privacy and complying with data protection laws, including the General Data Protection Regulation (GDPR), the UK GDPR, and the California Consumer Privacy Act (CCPA) as amended by the California Privacy Protection Act (CPPA). By using our websites, apps, newsletters, and digital services, you agree to this policy.  If we want to use your data in any other matter outside of this policy, we will seek your consent.

2. Information We Collect and Use Your Information

We collect a variety of information including personal information, content engagement data, device and technical data and cookies and tracking data as explained below: 

  • Personal Information:  This data includes information such as your name, email, subscription details, billing info, credit card information and account preferences. 

  • Content Engagement Data: This data includes information such as articles you read, videos watched, podcasts streamed, newsletter interactions and searches that you perform on our sites.  

  • Device & Technical Data:  This data includes your IP address, browser type, device identifiers, OS, approximate location. 

  • Cookies & Tracking Data: Info collected via cookies, pixels, SDKs, and similar technologies.

3. How We Use Your Information

We use your information to provide and manage your subscriptions, accounts, and your access to those accounts. Your information enables us to give you more meaningful and personalized recommendations, newsletters and ads.  By understanding your engagement with our sites, we can improve our product offerings and enhance the services that we provide to you.

4. Cookies & Consent Banner

We use cookies, web beacons or similar technology to provide our services.  Essential Cookies are used to provide the core functionality of our services.  Analytics Cookies are used to better understand ATM’s audience and site performance.   Advertising Cookies are used to deliver relevant ads and measure effectiveness of those ads.  Under GDPR/UK GDPR, non-essential cookies are only placed with your consent, managed via our cookie banner/Consent Management Platform (CMP).  Preferences can be updated anytime via 'Manage Cookies' or browser settings.

5. Sharing of Information

​

ATM may share your information with third-party service providers and business partners for limited purposes, including: payment processors, cloud hosting and storage providers, newsletter/email platforms, advertising and analytics providers, and event sponsors (in anonymized or aggregated form unless you provide consent). These third parties are contractually required to protect your information and may not use it for any purpose other than providing services to ATM. We do not sell your personal information. Under the CCPA/CPPA, some transfers may constitute “sharing” for cross-context behavioral advertising. You may opt out of such sharing at any time.

ATM also has an obligation to respond to any lawful government request or legal process such as a properly executed search warrant or subpoena.  ATM may also share your information in the event it believes a crimes is being committed, to defend itself or to protect its rights.

6. Data Retention

We retain your personal data only as long as necessary for the purposes set out in this policy, and in accordance with applicable laws. For example:

  • Account and subscription data: kept for the duration of your subscription and up to 7 years after cancellation for legal/tax obligations.

  • Marketing data: kept until you withdraw consent or unsubscribe, plus a short period to process your request.

  • Technical logs and analytics: retained for up to 24 months.
    When data is no longer needed, we securely delete or anonymize it.

7. Your Rights

You have rights and ATM wants to make sure you understand those rights.  Under the CCPA (as amended by CPPA), you have the right to know what personal information is collected, request deletion of that information, opt out of the sale/sharing of your data and you cannot be discriminated against for exercising your rights under the CCPA/CPPA. Under the GDPR/UK GDPR, you have the right to access, rectification, erasure, restriction, objection to the use of of your personal data, the ability to withdraw your consent at any time, data portability and the ability to file a complaint with a supervisory authority.

8. Security

ATM is committed to securing your data and has implemented appropriate technical and organizational measures, including encryption in transit and at rest, access controls, employee training, and regular security audits. While no system is 100% secure, these safeguards are designed to minimize the risk of unauthorized access, disclosure, or misuse.

9. International Data Transfers

We may transfer your personal data to countries outside the European Economic Area (EEA) or the United Kingdom. Where such transfers occur, we ensure they are carried out in compliance with applicable data protection laws and that your rights remain protected.

  • Adequacy Decisions: If the country to which we transfer data has been recognized by the European Commission (or the UK Government, where applicable) as providing an adequate level of data protection, we rely on that decision.

  • Derogations: In limited cases, we may rely on specific derogations under Article 49 GDPR, for example when a transfer is necessary for the performance of a contract with you, when you provide explicit consent, or when the transfer is necessary for important public interest reasons.

10. Children’s Privacy

​

Our services are not directed to children under 16 (or the age required by local law). We do not knowingly collect personal data from children. If we learn that we have collected data from a child without appropriate parental consent, we will delete it promptly.
